Conditions of Purchase
The Naples Winter Wine Festival (NWWF) is not responsible for the accuracy of the descriptions of auction lots contained in the online catalog. The descriptions incorporate, in some instances, materials or descriptions furnished by lot donors.
Any trips or events comprising all or part of an auction lot shall, unless otherwise specified in the description, be subject to convenient scheduling by the lot donor(s) and the winning bidder. NWWF is not responsible for any additions or modifications to an auction lot. To the extent the winning bidder seeks and is able to successfully procure modifications to the auction lot after the auction, said modifications will be made solely at the winning bidder’s cost and expense. Similarly, to the extent the winning bidder procures additional goods and/or services, upgrades or schedule changes to the auction lot, such additions, upgrades and changes shall be solely at the winning bidder’s expense and NWWF shall have no responsibility or liability therefore. In addition, unless otherwise specified, winning bidders of trips or events are required to schedule the trip or event to occur within twelve (12) months of the auction.
All auction items are sold on an “as-is” basis, and the NWWF does not make any express or implied warranty or representation of any kind or nature with respect to any property included in an auction lot.
The NWWF shall have the absolute right to withdraw any auction lot, reject any auction bid, or resolve any lot or any bid on any auction lot at any time before the close of the online auction. No bid is valid unless confirmed by the NWWF via a bid confirmation email and certain lots may be subject to a reserve. If the NWWF determines that any opening bid is not commensurate with the value of the article offered, the NWWF may reject the same and/or withdraw the article from sale. No one other than the NWWF is authorized to auction a lot. Auction lots will only be auctioned once and will not be duplicated.
All auction items sold at the NWWF online auction are subject to the provisions of Florida law and the regulations of the Florida Department of Revenue. Any property may be withdrawn, by the NWWF at any time before the actual sale, without any liability therefore.
The NWWF reserves the right to reject a bid from any bidder. The highest bidder acknowledged by the NWWF shall be the purchaser and is subject to all of the terms and conditions set forth herein and thereupon assumes the risk and responsibility thereof. In the event of any dispute between bidders, the NWWF shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the item in dispute. If any dispute arises after the sale, the NWWF’s determination shall be conclusive in all respects. NWWF takes no responsibility for any tax liabilities. Prior to acceptance of the prize, the winning bidder is strongly advised to seek professional legal and tax advice. If the foregoing conditions and other applicable conditions are not complied with, NWWF reserves the right to hold the winning bidder liable for the bid price, and may, in NWWF’s sole and absolute discretion, either: (a) cancel the sale, or (b) provide written notice to the winning bidder giving he or she a final payment notice, and if the winning bidder does not make payment in full within three (3) days after mailing of the written notice, resell the auction item on three (3) days’ notice to a third-party purchaser, on terms and conditions acceptable to NWWF in its sole and absolute discretion, and for the account and risk of the winning bidder, either publicly or privately, and in such event the winning bidder shall be liable for payment of any deficiency after the sale to the third-party purchaser, all other charges due hereunder and incidental damages.
All sales are final. Items are nontransferable, nonrefundable and cannot be exchanged for cash. The winning bidder is responsible for all required passport, visa, medical fees and other costs related to international travel. Payment and Sales Tax
Sales tax will not be collected based upon current law. According to the State of Florida Department of Revenue, since this is a one-time event held annually, sales are exempt. Buyers are fully responsible for and shall pay any applicable tax of another state, which NWWF may be required to collect, at the time of payment of the purchase price. NWWF accepts: VISA & MASTERCARD, through our online auction website (www.nwwfonlineauction.com). NWWF also accepts CHECKS, made payable to “Naples Children and Education Foundation, Inc.” The winning bidder at the close of the auction is solely responsible for full payment of the entire lot, in United States Dollars, prior to redemption of the auction lot, which shall be no later than 6:00 pm (EST) Monday, February 5, 2018.
Auction Lot Pickup, Delivery and Shipping
Items may be removed only by exhibiting a paid receipt at the time of pickup. Delivery and shipping arrangements including expenses and insurance are the sole responsibility of the winning bidder of the auction lot. Arrangements for pick up or delivery of items must be made with a representative at the NWWF office. NWWF is not liable for auction lots not redeemed by 6:00 pm (EST) Monday, February 5, 2018, and all risk of loss passes to the winning bidder upon the earlier of: (a) pickup of the auction lot by the winning bidder, (b) shipment of the auction lot, or (c) 6:01 pm (EST) Monday, February 5, 2018. NWWF shall have no liability with respect to the property purchased or for any matters following the passing of risk of loss to purchaser, and any liability of NWWF is strictly limited to refund of the purchase price actually paid.
Winning bidders shall be required to pay all federal, state and local retail sales or use taxes as may be applicable.
Federal Tax Information
For federal income tax purposes all payments for auction lots shall be made to the Naples Children and Education Foundation, Inc., which is classified as a tax-exempt corporation under Internal Revenue Code Section 501(c)(3). Tax identification number is 65-1001650. Bidders may be entitled to deduct a portion of their payments for auction lots as a charitable contribution; each bidder should consult her or his documentation as required by law and tax advisor following the auction.
All auction proceeds will meet the mission of the Naples Children & Education Foundation to support charitable programs that strive to make a profound and sustaining improvement in the physical, emotional and educational lives of underprivileged and at-risk children in Collier County, Florida.
